MINUTES OF PLANNING BOARD

Meeting was called to order at 7:02 p.m. by Chairman James Deming.
New Business:
- Steve Salvini, PLS from R Levesque Associates, Inc, applied for an Approval Not Required Subdivision of a ten (10) acre lot from a single lot containing over one hundred fifty (150) acres.
- The lot to be subdivided is located on Burt Hill Road, Map 410, lot 19, and is recorded in the names of Charlotte Clark and Janet Fox.
- As Frontage and acreage requirements will be met, the application was approved unanimously.
- Jeffery and Mary-Beth Ballard requested Site Plan Approval for the construction of a house on their property on School House Road, Map 413, Lot 1.1.
- Their lot is twenty-two (22) acres and meets the ARII frontage requirements.
- As all setback requirements will also be met, the Site Plan was approved unanimously.
- Judith France requested Site Plan Approval for the addition of a 10 x 12 foot shed on her property at 173 Owls Nest, Map 120, Lot 12. As all setbacks will be met, the application was approved unanimously.
- Keith Goyette of 9 Salem Road, Southwick, MA, appeared before the Board to discuss the possible creation of a recreation park for the use of motorized bicycles on a one hundred and seven (107) acre lot at 691 Hartland Road, Map 412, Lot 26. Since this type of business is not explicitly covered in Tolland’s Zoning By-Law, the Board agreed to look into whether a Special Permit could be issued in this case.
- William McKay, of 52 Otter Pond Trail, Map 114, Lot 72, requested Site Plan Approval for the construction of a 10 by 10 foot shed. All setbacks will be met.
- Gertrude McKay reclused herself from the discussion and voting on this matter
- The two remaining members voted their approval.
- The application will be held open until the missing members have an opportunity to vote.
- Rich Gemme applied for a Special Permit to build a 10 by 20 foot addition to an existing garage and a 10 by 24 foot second story deck to the rear of the garage for owner, Lawrence Jaquillard, at 173 Lands End Drive, Map 101, Lot 28.
- A check for one hundred seventy five dollars ($175) was received from the applicant.
- The existing garage is non-conforming as it is sits within the proscribed setback and the lot itself is non-conforming in size.
- This application was previously denied and referred to the Zoning Board of Appeals. The applicant requested a Variance and a Special Hearing was held.
- During the Hearing, the Zoning Board of Appeals decided that this application should be handled by the Planning Board, because the non-conforming garage existed before zoning.
- The Board decided to seek our Attorney’s advice, and if a Special Permit is applicable in this case, a Special Hearing will be scheduled, as soon as possible.
- Application was received from Timothy and Evelyn Deming, of 1403 New Boston Road, Map 403, Lot 7.7, for the construction of a 38 by 24 foot garage. All setbacks will be met.
- James Deming reclused himself from the discussion and voting on this matter.
- The two remaining members voted their approval.
- The application will be held open until the missing members have an opportunity to vote.
As there was no further business, the meeting was adjourned at 8:20 pm.
